Safety and Freedom: Students’ Rights in the Public School Setting

Teachers and school administrators have difficult jobs. Education can only occur in a safe environment, and establishing that environment is a baseline for any school. In enforcing school rules, however, it is important that teachers and administrators exercise discretion and treat each circumstance appropriately. Students have constitutional rights that must be protected. Moreover, the disciplinary actions taken by a school can have significant effects on a child’s future. It is important for parents, students, teachers, and administrators to understand how these factors interact in the school setting.

Attorneys Jason Asbell and Sheila O’Rourke will present on students’ constitutional rights in the public school setting, including the right to free speech and expression and the right to be free of unreasonable searches and seizures. They will also discuss due process rights, with special attention to disciplinary procedures and protections in public schools.

This seminar is a must for parents and students who desire to navigate the competing claims of safety and freedom.
